Terms of Service
The rules for using Thyme HQ’s hospitality workforce, operations, subscription, and dining reservation services.
1. Agreement, operator, and account types
These Terms of Service form an agreement between you and Thyme HQ (“Thyme HQ”, “we”, “us”, or “our”), ABN 81 932 315 481, registered at 4 Russell St, Evandale, Tasmania, Australia 7212. By creating an account, joining a workspace, starting a trial, purchasing a subscription, or otherwise using the service, you agree to these Terms. If you use Thyme HQ for a business or organisation, you confirm you have authority to bind it.
2. Eligibility, access, and the service
You must be at least 18 and legally capable of entering this agreement. You must provide accurate information, protect credentials, and report suspected unauthorised access. Thyme HQ provides hospitality workforce and operations tools, including scheduling, attendance, tip pooling, announcements, certification tracking, room status, dining reservations, table plans, and related workflows. Features, limits, and availability vary by plan.
3. Business responsibilities and workspace data
Thyme HQ is an operational tool, not an employer, payroll provider, booking agent, legal adviser, accountant, or workplace-compliance service. Businesses remain responsible for employment decisions, rosters, wages, awards, taxes, tips, safety, licences, guest communications, accessibility, and applicable laws. You retain rights in submitted information and grant us a limited licence to host, process, transmit, and display it only to operate, secure, support, and improve the service. Businesses must have a lawful basis and required notices or consents for personal information they submit.
4. Guest reservations
Restaurant and hotel managers may publish a booking link and configure areas, tables, capacities, service windows, and booking rules. The business must keep that information accurate and honour, change, or cancel bookings under applicable law and its guest policies. Thyme HQ is not a party to the arrangement between that business and its guest and is not responsible for fulfilment, no-shows, externally entered overbooking, or guest disputes.
5. Trials, subscriptions, automatic renewal, and promotions
Eligible manager accounts may receive a 14-day free trial without providing payment details. Before the trial starts, we show the selected plan, price, billing interval, trial length, and relevant renewal terms. If you do not add a payment method, the trial subscription ends automatically after 14 days. If you add a payment method and continue, you authorise Thyme HQ and Stripe to charge the applicable recurring subscription fee at the selected monthly or annual interval unless you cancel before renewal. Checkout shows applicable price, currency, limits, discounts, and taxes. We may change recurring prices only with advance notice required by applicable law and an opportunity to cancel.
6. Cancellation, refunds, and failed payments
You can cancel before renewal through account billing controls or by contacting us below. Cancellation stops the next renewal and access normally continues through the end of the current paid period. Except where mandatory law or an express offer says otherwise, fees already paid are non-refundable. Payments are processed by Stripe; Thyme HQ does not store full payment-card details.
7. Acceptable use and intellectual property
You must not use Thyme HQ unlawfully; infringe another person’s rights; access another account without permission; disrupt, scrape, probe, or circumvent security; introduce malware, spam, or abuse; or resell the service without written agreement. Thyme HQ and its software, design, branding, documentation, and service content are owned by Thyme HQ or its licensors. During an active trial or subscription, we grant a limited, revocable, non-exclusive, non-transferable right to use the service for internal operations.
8. Providers, availability, suspension, and termination
Thyme HQ uses third-party services, including Clerk for authentication and Stripe for payments. Their terms and privacy practices may apply. We aim for reliable service but do not promise uninterrupted, error-free, or permanent availability. We may suspend or terminate access for material breach, non-payment, security or legal risk, misuse, or where required by law.
9. Disclaimers and liability
To the maximum extent permitted by law, Thyme HQ is provided “as is” and “as available”. Nothing excludes a guarantee, warranty, remedy, or right that cannot lawfully be excluded. Our aggregate liability arising from the service or these Terms is limited to the greater of USD $100 or fees you paid us in the 12 months before the event giving rise to the claim.
10. Consumer-law savings, disputes, and general terms
Nothing in these Terms excludes rights or remedies that cannot be excluded under applicable consumer, privacy, employment, or other laws, including the Australian Consumer Law, New Zealand consumer law, UK consumer law, and applicable United States law. These Terms do not select an exclusive governing law or court. Before formal proceedings, please contact us and give both sides a reasonable opportunity to resolve the issue. We may update these Terms and will normally give at least 30 days’ notice of a material change unless a shorter period is required for legal or security reasons.
